These Terms of Service apply to your use of inkedvipstudio.com and to all purchases, appointments, treatments, training, and other services provided by Ly TriVinh, doing business as Inked VIP Studio.

Throughout these Terms, “we,” “us,” and “our” refer to Inked VIP Studio. “You” and “customer” refer to any website visitor, purchaser, client, student, or service recipient.

By accessing our website, purchasing a product, booking an appointment, or receiving a service, you agree to these Terms of Service, our Return and Refund Policy, Shipping Policy, Privacy Policy, and any additional policies or consent forms applicable to your purchase or service.

1. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to place an order, create an account, or book a PMU procedure.

We reserve the right to request valid government-issued identification before providing age-restricted products or services.

2. Permanent Makeup Services

Our permanent makeup services may include eyebrow, eyeliner, lip, corrective, camouflage, or other cosmetic tattoo procedures listed on our website or booking platform.

Permanent makeup is considered body art under California law and may be subject to state and local health department requirements. Our procedures are provided only when we determine that the service may be performed safely and lawfully.

Before receiving a procedure, clients may be required to:

  • Present valid government-issued identification
  • Complete health history, consent, and release forms
  • Disclose relevant medical conditions, allergies, medications, skin conditions, previous procedures, and pregnancy or nursing status
  • Follow all pre-care instructions
  • Receive medical clearance when requested
  • Review and approve the proposed shape, placement, and color
  • Follow all written aftercare instructions

Providing false, incomplete, or misleading health information may result in cancellation of the appointment without a refund.

3. Right to Refuse or Postpone Service

We may refuse, discontinue, or postpone a procedure when we believe that:

  • The service may be unsafe or unsuitable
  • The client has a contraindication, infection, irritation, open wound, or active skin condition
  • The client appears impaired by alcohol, medication, or another substance
  • Required consent or identification has not been provided
  • The client has not followed pre-care instructions
  • The client behaves in a threatening, abusive, disruptive, or inappropriate manner
  • Performing the procedure would violate professional, health, safety, or legal requirements

Our decision to refuse or postpone a procedure is made for safety and compliance purposes.

4. Results and Healing

Permanent makeup results vary from person to person. Final results may be affected by:

  • Skin type and condition
  • Age and natural skin changes
  • Existing pigment or previous permanent makeup
  • Medications and medical conditions
  • Lifestyle and sun exposure
  • Bleeding, swelling, or sensitivity
  • Aftercare
  • Individual healing response
  • Pigment retention and fading

We do not guarantee exact symmetry, color, shape, retention, fading pattern, healing time, or final appearance.

Permanent makeup may require more than one session. A touch-up or perfecting session is not included unless specifically stated in the service description or booking agreement.

5. Client Approval

The client is responsible for reviewing and approving the proposed design, color, placement, and overall plan before the procedure begins.

Once the client approves the design and the procedure begins, changes may not be possible without additional sessions, removal, correction, or additional fees.

Photographs, drawings, digital previews, and examples are for reference only and do not guarantee an identical result.

6. Appointments, Deposits, and Cancellations

A deposit or booking fee may be required to reserve an appointment. Unless otherwise stated, all deposits and booking fees are nonrefundable.

Appointments may be rescheduled once when at least 48 hours notice is provided.

A new deposit may be required when:

  • Less than the required notice is provided
  • The client misses the appointment
  • The client arrives more than 15 minutes late
  • The client reschedules more than once
  • The appointment cannot proceed because the client failed to follow instructions
  • The client does not provide required identification, forms, or medical clearance

Completed services are final and nonrefundable.

Any mandatory fee connected to a California consumer service should be included in the advertised price, except permitted taxes and reasonable shipping charges.

7. Touch-Ups and Corrective Work

Touch-up appointments are subject to availability and may require an additional fee.

A touch-up may not be performed until the treated area has fully healed. The appropriate healing period will be determined by the practitioner.

Additional fees may apply when:

  • The touch-up is requested outside the stated timeframe
  • The client did not follow aftercare instructions
  • Significant pigment loss occurred because of skin characteristics or lifestyle factors
  • The client requests a different shape, style, or color
  • Correction or neutralization of previous work is required
  • The original service was performed by another practitioner

We reserve the right to decline corrective work when the desired result is not reasonably or safely achievable.

8. Product Purchases

We sell PMU machines, pigments, cartridges, supplies, tools, accessories, and related products.

Products must be used only for their intended purpose and according to manufacturer instructions.

Customers are responsible for:

  • Reviewing product descriptions and specifications
  • Confirming compatibility before purchase
  • Reading all labels, warnings, and instructions
  • Checking expiration dates and storage requirements
  • Maintaining appropriate sanitation and infection-control practices
  • Obtaining all required licenses, training, permits, and insurance
  • Confirming that the product may legally be purchased and used in their location

Purchasing a product from us does not certify, license, authorize, or qualify the customer to perform permanent makeup procedures.

9. Professional-Use Products

Certain products may be intended only for trained or licensed professionals.

By purchasing or using professional-use products, you represent that you have the knowledge, training, credentials, and legal authority required to use them.

We are not responsible for injury, infection, pigment complications, equipment damage, client claims, or other losses resulting from improper use, inadequate training, failure to follow instructions, or failure to comply with applicable laws.

10. Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, colors, measurements, specifications, and pricing.

However:

  • Product colors may appear differently because of screens, lighting, photography, and device settings
  • Packaging and labels may change without notice
  • Manufacturers may update specifications or accessories
  • Pigment appearance may vary depending on skin tone, technique, healing, and other factors
  • Minor cosmetic variations do not necessarily indicate a defect

We reserve the right to correct errors, update information, limit quantities, or cancel an order affected by an obvious pricing or listing error.

11. Returns and Manufacturing Defects

All product sales are final except qualifying PMU machines with a verified manufacturing defect.

Customer-caused damage is not considered a manufacturing defect. This includes damage caused by:

  • Dropping or impact
  • Liquid exposure
  • Improper cleaning or storage
  • Misuse or incorrect operation
  • Incompatible chargers, power supplies, accessories, or cartridges
  • Unauthorized repairs, modifications, or disassembly
  • Normal wear and tear
  • Failure to follow manufacturer instructions

Claims must comply with our Return and Refund Policy. We may require photos, videos, troubleshooting, inspection, and return of the machine before determining whether the issue qualifies.

We may deny claims when the machine shows evidence of customer damage, misuse, unauthorized alteration, or normal wear.

12. Shipping

Shipping, tracking, transit damage, lost packages, insurance claims, incorrect addresses, and unclaimed packages are governed by our Shipping Policy.

Customers must provide complete and accurate shipping information.

We do not process unauthorized returns or packages returned because of an incorrect address, refused delivery, failed delivery attempt, or failure to collect the shipment.

13. Training, Classes, and Educational Content

Training, demonstrations, consultations, classes, videos, manuals, and educational materials are provided for informational and educational purposes.

Completing a course or purchasing training does not guarantee:

  • Licensing or certification by a government agency
  • Employment or business income
  • Mastery of a procedure
  • Eligibility to perform services in every jurisdiction

Students are responsible for researching and complying with the licensing, registration, insurance, facility, health department, and scope-of-practice requirements that apply to them.

14. Medical Disclaimer

The information on our website and in our educational materials is not medical advice and is not a substitute for evaluation or treatment by a qualified healthcare professional.

We do not diagnose medical conditions or guarantee that a product or procedure is appropriate for every person.

Clients and customers should seek medical advice when they have questions about allergies, medications, pregnancy, healing, skin conditions, infections, or other health concerns.

15. Prices and Payment

All prices are listed in U.S. dollars, unless otherwise stated.

Payment must be successfully authorized before an order is fulfilled or an appointment is confirmed.

California generally requires advertised consumer prices to include mandatory fees, excluding permitted government taxes and reasonable shipping costs. Therefore, required booking or service fees should be included in the displayed service price rather than added later.

We may refuse or cancel a transaction because of:

  • Suspected fraud
  • Unauthorized payment
  • Pricing or inventory errors
  • Unusual purchasing activity
  • Suspected resale or misuse
  • Violation of these Terms

16. Chargebacks and Payment Disputes

Customers agree to contact us at inkedvipcali@gmail.com before initiating a payment dispute so that we have a reasonable opportunity to address the concern.

Submitting a fraudulent chargeback, falsely claiming that an authorized purchase was unauthorized, or misrepresenting delivery or service records may result in suspension of future purchasing or booking privileges.

Nothing in this section limits any lawful rights available to a consumer.

17. Promotions and Discount Codes

Promotions, discounts, bundles, and discount codes may be subject to separate conditions, expiration dates, quantity limits, and product exclusions.

Discounts:

  • Have no cash value
  • Cannot be combined unless expressly permitted
  • Cannot be applied retroactively
  • May be modified or discontinued before purchase
  • May be canceled when obtained through misuse, fraud, or technical error

18. Intellectual Property

All website content and business materials, including logos, photographs, videos, graphics, product descriptions, forms, guides, manuals, course materials, designs, and branding, are owned by or licensed to Inked VIP Studio.

You may not copy, reproduce, distribute, upload, publish, modify, resell, teach from, or commercially exploit our content without prior written permission.

Purchasing a product, service, or course does not transfer ownership of our intellectual property.

19. Reviews, Photographs, and User Content

When you submit a review, photograph, testimonial, comment, or other content to us, you confirm that:

  • The content is accurate and based on your genuine experience
  • You have the right to submit it
  • It does not violate another person’s privacy or intellectual-property rights
  • It is not unlawful, threatening, defamatory, deceptive, or harmful

We may remove content that violates these Terms.

Client photographs or videos taken before, during, or after a procedure will be used for advertising, education, or social media only when the client provides the required permission or release.

20. Prohibited Activities

You may not:

  • Use our website or products for unlawful purposes
  • Purchase products using fraudulent payment information
  • Interfere with website security or functionality
  • Introduce viruses, malicious code, or automated scraping tools
  • Copy or resell our protected content without permission
  • Impersonate another person
  • Harass our staff, practitioners, students, or customers
  • Make false statements in a refund, shipping, insurance, or payment claim
  • Use our products in violation of health, sanitation, licensing, or body-art laws

21. Third-Party Services

Our website may use third-party services, including Shopify, payment processors, booking platforms, shipping carriers, analytics providers, and social media platforms.

We are not responsible for the independent actions, availability, policies, security practices, or content of third-party services.

Your use of a third-party service may also be subject to that provider’s terms and privacy policy.

22. Disclaimer of Warranties

To the fullest extent permitted by law, our website, products, educational materials, and services are provided without warranties beyond those expressly stated in writing.

We do not warrant that:

  • The website will always be uninterrupted or error-free
  • A product will produce a specific healed result
  • A service will meet every client’s personal expectations
  • Educational content will result in licensing, employment, or financial success

Nothing in these Terms excludes any warranty or consumer right that cannot legally be waived.

23. Limitation of Liability

To the fullest extent permitted by law, Inked VIP Studio, its owners, employees, contractors, practitioners, instructors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from:

  • Improper product use
  • Failure to follow instructions or aftercare
  • Undisclosed medical information
  • Individual healing or pigment retention
  • Unauthorized or unlicensed procedures
  • Shipping delays or carrier actions
  • Third-party services
  • Website interruptions
  • Loss of profits, business, data, or opportunity

Our total liability for a product purchase will not exceed the amount paid for the product giving rise to the claim, except where a different remedy is required by law.

Our total liability for a service will not exceed the amount paid for that specific service, except where liability cannot legally be limited.

24. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Inked VIP Studio, its owners, employees, contractors, practitioners, instructors, and representatives from claims, damages, liabilities, and expenses arising from:

  • Your unlawful or improper use of a product
  • Your failure to follow instructions
  • Your violation of applicable licensing or health regulations
  • Your violation of these Terms
  • Your infringement of another person’s rights
  • Services you perform on your own clients

This section does not apply where prohibited by law.

25. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Any legal proceeding shall be brought in a court with proper jurisdiction in Orange County, California, unless applicable consumer law permits or requires otherwise.

26. Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

The invalid provision will be limited or modified only to the extent necessary to make it enforceable.

27. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

28. Changes to These Terms

We may update these Terms periodically.

The version posted on our website at the time of a purchase or booking will generally apply to that transaction. Continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms where permitted by law.

29. Entire Agreement

These Terms, together with our posted policies, booking conditions, consent forms, and written service agreements, constitute the agreement between you and Inked VIP Studio concerning the applicable purchase or service.
